How long do I have to file a maritime claim?

A Maritime claim can be filed in a state or federal court and the statute of limitations is different for each type of case. For example, in Texas, if you are filing a maritime personal injury claim, you have three years from the date of injury to file the lawsuit. If you don't file within that three-year time frame, then your case will be forever barred. There are a few exceptions to this rule including when an injury is discovered after the statute of limitations has already expired as well as when there was fraud committed by another party on behalf of the injured party.

Do I have a case even though there are no witnesses or documentation of what happened?

One of the most common questions we hear from clients is Do I have a case even though there are no witnesses or documentation of what happened? You may be surprised to know that you do have a case if you were injured offshore. Here are three reasons why:

1) You have the right to sue for damages if your injury occurred during your employment at sea, regardless of whether there were any witnesses to the incident. 2) If you don't know who caused your injury, then the law permits you to file suit against any responsible person or party, including their employer. 3) It is not necessary that you prove who was at fault in order to recover damages; it's enough if your injuries resulted from an accident which could be traced back to someone else's negligence.
